Court decision stops NFT showcase
The saga took a new twist when U.S. District Court Judge Jed S. Rakoff issued a final ruling with a permanent injunction, effectively halting Rothschild’s alleged trademark violations against Hermès.
More recently, Rakoff expanded this ban by preventing MetaBirkins’ belongings from being displayed at the Spirit Museum in Stockholm. Such a decision followed Rothschild’s request for legal clarification on the exhibit despite the court’s previous ruling.
In his latest comments, Rakoff openly labeled Rothschild a “straight-up con man,” with the NFT maker disputing this accusation.
Looking ahead, Rothschild continues to challenge the court ruling from the previous year, and an appeal is still pending in New York’s Second Circuit Court.
Rhett Millsaps, Rothschild’s attorney, is about to file a motion for reconsideration, heralding the next chapter in a legal saga that questions the boundaries of artistic NFTs and corporate branding.
